General Terms and Conditions of Sale – Martine Caudron Mikaeloff
 

These General Terms and Conditions of Sale (hereinafter “T&Cs”) apply to all sales made on the website of Martine Caudron Mikaeloff. They are communicated to every buyer to enable them to place an order. Any order implies full and unconditional acceptance of these T&Cs by the buyer.
The general terms and conditions of sale set out below detail the rights and obligations of Martine Caudron Mikaeloff and her customers in the context of the sale of the following goods: ceramic tableware and decorative items.

 

Article 1: Orders – Information and Validation
 

To place an order, the buyer must ensure the accuracy and completeness of the information provided and is responsible for keeping it up to date. In case of an error in the recipient’s details, Martine Mikaeloff cannot be held liable for the inability to deliver the products.
Providing the bank card number and the final validation of the order constitute proof of the buyer’s consent and an electronic signature within the meaning of Belgian law.
After reviewing the order summary and accepting these T&Cs, the buyer validates the payment. The order is then recorded in the seller’s computer systems, stored on a reliable and durable medium, and serves as proof of the contractual relationship. An order summary is displayed and sent by e-mail to the address provided at the time of ordering, including the essential terms of the contract.
Acceptance of any quotation or order form, including the clause “I acknowledge that I have read and accept the attached general terms and conditions of sale,” implies full and unconditional acceptance of these T&Cs by the buyer.

 

Article 2: Order Cancellation
 

Martine Mikaeloff reserves the right to withdraw any product from the website, to modify its content, or to cancel an order even after confirmation, in the event of legitimate reasons (such as prior payment disputes, suspected fraud, stock shortages, etc.). The site cannot be held liable for any resulting damages; however, the buyer will be fully reimbursed as soon as possible if payment has already been made.

Article 3: Delivery

Martine Mikaeloff undertakes to process orders within 8 to 10 business days. This period may extend to 15 business days depending on the products.
Delivery is deemed complete when the consumer physically takes possession of the goods. Until that moment, the seller bears the risk of loss or damage in accordance with European law.
Shipping and packaging costs are included in the price paid at the time of order.

 

Article 4: Payment Terms
 

Payment is made online via the secure PayPal platform by credit card. The data is encrypted and never passes through the servers of Martine Caudron Mikaeloff. Other payment methods may also be offered (e.g. bank transfer, Bancontact).

For orders placed outside the online store, payment is made by bank transfer under the following conditions:

  • 30% upon order,

  • Balance before shipment.

In case of payment refusal or dispute, the seller reserves the right to refuse or cancel an order.
 

Article 5: Claims and Legal Warranty
 

The buyer must check the condition of the products upon receipt. Any claim relating to an apparent defect or non-conformity must be submitted in writing within 72 hours of receipt. After this period, the products will be considered compliant.
All claims must include supporting documents (photos, order number, etc.). If a defect is confirmed, Martine Mikaeloff undertakes to replace the products as soon as possible and at her own expense.
In addition, the buyer benefits from the 2-year statutory warranty of conformity provided by Belgian and European law, applicable to all consumer goods.

 

Article 6: Right of Withdrawal
 

In accordance with applicable law, the buyer has a period of 14 days from receipt of the goods to exercise their right of withdrawal, except for customized or made-to-order products.
Products must be returned in their original condition and packaging, at the buyer’s expense. Reimbursement will be made within 14 days after receipt and inspection of the returned products.

 

Article 7: Returns
 

Returns must be carried out under the conditions set out in Article 6 (withdrawal) or Article 5 (claims), using a tracked shipping method (such as Colissimo) that allows proof of return.
 

Article 8: Products
 

The products offered are those described on the website, within the limits of available stock. In the event of unavailability, the company undertakes to inform the buyer as soon as possible and to provide a full refund if payment has already been made.
Despite careful attention to product descriptions, errors may occur, which the buyer accepts.

 

Article 9: Prices
 

Prices are indicated in euros, inclusive of all taxes. Shipping costs are added at checkout.
The prices charged are those in effect on the day of the order. Martine Caudron Mikaeloff reserves the right to modify her prices at any time but undertakes to invoice the goods ordered at the price indicated at the time of order registration.

 

Article 10: Discount
 

No discount will be granted in the case of early payment.
 

Article 11: Personal Data
 

Data collected is necessary for order management and is processed in compliance with the GDPR.
Buyers have the right to access, rectify, delete, and transfer their personal data, which they may exercise via the contact form. Data is retained only for the duration necessary to manage the business relationship and in accordance with legal obligations.

 

Article 12: Cookies
 

The site uses cookies to improve the user experience. A consent banner informs users upon their first visit and allows them to accept or refuse non-essential cookies. Users may also configure their browser to refuse cookies.
 

Article 13: Web Beacons
 

Certain pages may contain web beacons for traffic statistics. These data are collected anonymously via GDPR-compliant tools (e.g. Google Analytics).
Users may opt out of this processing by configuring their preferences via the cookie banner.

 

Article 14: Retention of Title
 

Martine Caudron Mikaeloff retains ownership of the goods sold until full payment of the price, including principal and ancillary costs.
 

Article 15: Force Majeure
 

Martine Caudron Mikaeloff cannot be held liable in cases of force majeure, defined as any external, unforeseeable, and irresistible event, including but not limited to: strikes, natural disasters, pandemics, transport blockages.
 

Article 16: Disputes
 

These T&Cs are governed by Belgian law.
In the event of a dispute, the buyer may use a consumer mediation service free of charge before initiating legal proceedings.
Failing an amicable resolution, disputes shall be brought before the Commercial Court of the seller’s registered office.
